The following is intended as a guide only: All new governors are asked to sign a form saying they are not disqualified from being a governor. If you have any questions, please contact the Governor Support Officer,22 Northgate Street, Warwick.
The following will lead to automatic disqualification from a school governing body.
1. Mental Disorder Any person liable to be compulsorily detained under the Mental Health Act 1983.
2. Bankruptcy Anyone bankrupt or disqualified under the Company Directors Disqualification Act 1986 or an order made under section 429(2)(b) of the Insolvency Act 1986.
3. Persons whose employment is prohibited or restricted A person who is included in the list (List 99) of teachers and workers with children or young persons whose employment is prohibited or restricted.
4. Criminal Convictions The following are disqualified:- · Anyone sentenced to 3 months or more in prison, without the option of a fine, in the last 5 years. · Anyone sentenced to 2½ years or more in prison in the last 20 years. · Anyone sentenced to 5 years or more in prison, at any time. · Anyone fined for causing a nuisance or disturbance on school premises in the last 5 years.
For the purpose of the above convictions, any conviction by a Court outside the United Kingdom of an offence which, if the facts leading to the offence had arisen in the United Kingdom, would not have constituted an offence under the law of the United Kingdom, shall be disregarded.
5. Other Disqualifications Disqualified Company Directors, disqualified Charity trustees and disqualified Proprietors of Independent Schools are disqualified from serving as School Governors.
6. Failure to attend Meetings Please note that any governor (apart from an ex-officio governor) who, without the consent of the governing body, has failed to attend meetings for a continuous period of six months beginning with the date of the first meeting missed, will also be automatically disqualified from a governing body, and cannot be reappointed in the same category for a period of 12 months.
